Electronic Communications Consent

This Electronic Communications Consent notice has been prepared to explain the scope of consent for electronic communications that Webrote may send for promotional, marketing, campaign, announcement and similar commercial purposes, together with communication preferences and users’ opt-out rights.

Contacting Webrote, submitting a project request or asking for information about our services does not by itself mean that you have consented to commercial electronic communications. Where required, consent for commercial electronic communications is obtained separately and through the user’s clear choice.

Scope of Electronic Communications Consent

Electronic communications consent may cover promotional and marketing communications relating to services offered by Webrote, new services, content, announcements, campaigns, opportunities or Webrote’s activities, sent through the communication channels for which permission has been given.

Consent is used only for the stated purposes and communication channels. Consent given to Webrote does not constitute general permission for independent marketing activities carried out by individuals or organisations outside Webrote.

What Is a Commercial Electronic Communication?

A commercial electronic communication is a communication sent through electronic communication channels for purposes such as promoting or marketing a business’s goods or services, increasing the visibility of the business or pursuing similar commercial objectives.

This may include campaign and promotional messages, announcements of new services, commercial opportunities, marketing content and similar communications.

How Is Consent Given?

Consent for commercial electronic communications may be given physically or electronically through a positive indication of the individual’s wishes. Where consent is obtained electronically, the communication channel or channels covered by that consent are identified clearly.

Options relating to electronic communications consent are not presented as pre-selected choices. Users are not required to consent to commercial electronic communications in order to use a service or submit a project or contact request.

Where consent for commercial electronic communications is obtained electronically, information confirming that consent has been obtained and the available means of opting out are communicated to the relevant contact address in the manner required by applicable legislation.

Communication Channels

Depending on the system used and the user’s preferences, consent for commercial electronic communications may be given for one or more of the following channels:

  • Email,
  • SMS or other short-message systems,
  • Telephone or voice calls,
  • Other electronic communication channels that qualify as commercial electronic communications under applicable legislation.

Consent given for one communication channel does not automatically constitute consent for other channels unless applicable law or the scope of the consent obtained provides otherwise.

Scope of Communications Sent

Commercial electronic communications sent by Webrote are prepared in accordance with the scope of consent obtained from the user.

Commercial electronic communications include the information required to identify the sender and a method that allows the user to withdraw consent for the relevant communication channel easily and free of charge.

Where a commercial communication relates to a discount, campaign, promotion or other special conditions, the scope of the relevant campaign and the conditions for benefiting from it are stated as clearly and understandably as reasonably possible.

Contact and Project Requests Are Not Marketing Consent

Using Webrote’s contact or project forms, sending an email to Webrote, requesting a proposal or asking for information about a service does not by itself constitute consent to receive commercial electronic communications for marketing or promotional purposes.

Responses required to evaluate a contact or project request, project discussions, proposal processes or operational communications directly related to an ongoing service may, depending on their content and applicable law, be treated differently from commercial marketing messages.

Communications That May Not Require Prior Consent

Under applicable legislation, separate consent for commercial electronic communications may not be required for certain types of electronic communication.

Where the relevant conditions are met, notifications required for an ongoing service relationship, purchase, payment, invoice, use of a service, information update, security notice or similar operational process may be sent independently of commercial electronic communications consent.

Such communications are limited to the relevant operational or legal purpose and, where they are sent solely as notifications that do not require consent, additional promotional or marketing content is not included.

Special provisions and exemptions under applicable legislation relating to commercial electronic communications sent to recipients acting as merchants or tradespeople remain reserved.

Withdrawal of Consent and Opt-Out Rights

Users may withdraw consent for commercial electronic communications without having to provide a reason.

Commercial electronic communications sent by Webrote provide a method allowing the user to withdraw consent for the relevant communication channel easily and free of charge. The opt-out process may be carried out using a method appropriate to the type of communication channel used.

After an opt-out request reaches Webrote, commercial electronic communications through the relevant channel are stopped within the period required by applicable legislation and no later than three business days.

Withdrawing consent for commercial electronic communications does not by itself prevent a user from receiving Webrote services, continuing an existing project relationship or receiving mandatory notifications that must be sent under applicable law or as part of a service relationship.

Commercial Electronic Message Management System (İYS)

The Commercial Electronic Message Management System (İYS) is Türkiye’s national system for managing consent and opt-out records relating to commercial electronic communications.

Where Webrote’s commercial electronic communications activities are subject to registration or notification requirements under the İYS framework, relevant consent and opt-out records are managed in accordance with the applicable İYS rules.

Where applicable under the legislation, users may view their registered commercial electronic communications permissions through İYS and exercise their opt-out rights through the system.

Retention of Consent and Opt-Out Records

Records relating to consent, opt-out requests and communications may be retained where necessary to demonstrate that commercial electronic communications consent was obtained properly and that user preferences were applied correctly.

These records may include the contact address, permitted communication channel, date of consent or opt-out, method used and other technical records required under applicable legislation.

Consent and commercial electronic communications records are retained with regard to minimum retention periods required by applicable legislation and may be provided in response to duly submitted requests from competent authorities.

Protection of Personal Data

Contact and consent information used when obtaining and managing commercial electronic communications permissions may constitute personal data.

Independence of Electronic Communications Consent

Consent for commercial electronic communications is not a general prerequisite for visiting the Webrote website, contacting Webrote, submitting a project request or receiving services from Webrote.

A user’s decision not to give consent for commercial electronic communications, or to withdraw consent previously given, does not prevent the user from contacting Webrote or from continuing processes relating to requested services, provided that the other applicable conditions are met.

Changes to This Electronic Communications Consent Notice

Webrote may update this Electronic Communications Consent notice in response to changes in the communication methods used, commercial electronic communications processes or applicable legislation.

The current version is published on this page. Changes that would expand the scope of consent previously given by a user are not treated as accepted solely because this notice has been updated where applicable law requires separate consent for that expanded scope.
